Why does Strandvik Homeowners Association continue to burn money on legal fees

Why is Strandvik HOA burning reserves on legal fees for an easement it doesn't know where it is and declared by its president Karl Lindor that it is an inactive easement; and confirmed by past president Marc Bothel in August 2015 that he has no idea where the easement is and why Strandvik even needs an easement to access the lake when it has its own Strandvik private beach.


It is strange that Strandvik HOA and its members agree to burn more money on legal fees when its President Karl Lindor wrote an email on August 31, 2016 at 8:56AM that says:

"As stated in our meeting, since we have now confirmed we are unaware of where the easement is located and would all agree that this is not an active easement we most likely have no case against Ko at this point.  My email of last week confirmed we don't know where the easement is located. I'm, speaking with Demco law again today to confirm the HOA can legally barter an exchange of releaseing the easement in exchange for a side yard access easement for the Chestnut property."


This email is in the possession of a few Strandvik property owners, yet Strandvik's legal counsel LarsN wrote in their Mediation Brief that no one said the easement was inactive.  How do you dispute Karl Lindor's own email?   You have to remember what is said and written before you change the story line.

Why is Karl leveraging my property rights for the benefit of another owner?  Strandvik HOA is supposed to represent all members; not just one.  Association reserves are for the benefit of all members who are assessed quarterly dues.

Strange that Strandvik was quick to resolve a law suit with another Strandvik owner on 177th Ave SE.  But for me, an owner of color, Karl and the Strandvik HOA are buring Strandvik reserves on an inactive easement that neighbors named by Darin Chestnut have confirmed they do not use.

A few days later on Sep1, 2016 10:23AM, Karl sent an email to Lisa and Darin Chesstnut, SallyW, MarcB, MattW, and JulieR titled "Ko Easement Vacation and Fence Installation" where Karl wrote:

"I just reviewed the current status of the fence, gate and easement with LarsN at Demco Law again and he confirmed that based on the facts of this situation this is NOT (emphasis added) an HOA issue.  I have given Lars the ok to speak with Chestnut's legal counsel on this, he will be returning a call to them today."

So, Strandvik's legal counsel's opinion is "the fence, gate and easement" is NOT an HOA issue.  Yet the HOA did not rescind or cancel the resolution passed during the Annual HOA Meeting on August 8, 2016 to remove my fence.
